A division bench comprising Justice Vijay Kumar Shukla and Justice Alok Awasthi passed the order while hearing multiple writ petitions and an appeal filed by various parties, including Hindu Front for Justice, against the Union of India and other respondents.

During the hearing, senior advocate Salman Khurshid, appearing for one of the respondents, referred to a recent order of the Supreme Court, which stated that objections arising from videography at the disputed site must also be considered.

Referring to the apex court s direction, the High Court said it must examine all objections, both previously raised and those emerging from the videographic record, while ensuring adherence to principles of natural justice.

Taking into account the Supreme Court s January 22 order and its own directions issued on March 11, the High Court fixed a consolidated hearing for all related matters.

The dispute concerns Bhojshala, an 11th-century monument in Dhar protected by the Archaeological Survey of India (ASI). The site holds religious significance for both Hindus and Muslims.

Hindus consider the structure a temple dedicated to Goddess Vagdevi (Saraswati), while Muslims regard it as the Kamal Maula Mosque.

Under a 2003 arrangement by the ASI, Hindus are allowed to perform pooja on Tuesdays and Muslims to offer namaz on Fridays.

On February 23, the High Court directed all parties to submit objections and responses regarding the scientific survey conducted by the ASI. On March 16, the judges hearing the matter decided to visit the site.
